Article 1. Purpose
These terms and conditions of sale are intended to define the contractual relationship between Comme un diadème and the buyer and the conditions applicable to any purchase made through the websitewww.commeundiademe.com. The purchase of a product through this website implies the buyer's unconditional acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the websitewww.commeundiademe.comis not directly related to their professional activity and is limited to strictly personal use and, on the other hand, that they have full legal capacity, allowing them to commit to these general terms and conditions of sale.
Comme un diadème reserves the right to modify these terms and conditions of sale at any time in order to comply with any new regulations or to improve the use of its website. Therefore, the applicable terms and conditions will be those in force on the date of the buyer's order.
Article 2. Products
The products offered are those listed on the Comme un diadème websitewww.commeundiademe.com, subject to availability. Comme un diadème reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description detailing its main technical characteristics (hair type, length, size and type of base, density). The photographs are as accurate as possible to the models but are not binding on the seller. There may be slight variations between models of the same reference over the months or years. In this case, the photos are replaced with those of the new model of the same reference. The sale of products presented on the websitewww.commeundiademe.comis intended for all buyers residing in countries that fully authorize the entry of these products into their territory.
Article 3. Rates
The prices listed on the product pages of the online catalog are in euros (€). Comme un diadème reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only price applicable to the buyer. The prices indicated include delivery costs for the order. Outside the European Union and in the French overseas departments and territories, the price is invoiced excluding VAT. It is the customer's responsibility to find out about and pay any other taxes applicable at the destination (customs duties, sea taxes, etc.) in accordance with Incoterm DAP (Delivered at Place). Shipping costs for toppers wigs are free worldwide. Other products (Hairbun and Sensitive grip) are shipped (free shipping) only to mainland France and the European Union.
Article 4. Ordering and payment terms
Before placing an order, the buyer must create an account on the website www.commeundiademe.com. The account creation section can be accessed directly from the side menu bar. Each time they visit the site, buyers who wish to place an order or view their account (order status, profile, etc.) must log in using their personal information and login details. Comme un diadème accepts no responsibility for the use of personal login details by a third party.
Comme un diadème allows buyers to order and pay for their products in several stages, with a choice of three payment options:
Secure payment by credit card:the buyer selects the products they wish to order in the "shopping cart," modifies it if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier (DHL). Next, the buyer chooses the credit card payment method. The next step invites them to check all the information, read and accept these general terms and conditions of sale by checking the corresponding box, and then asks them to confirm their order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure interface to safely enter their personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the buyer may demand cancellation of the card payment, and the sums paid will then be credited or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of their card. To obtain a refund of the fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must dispute the debit in writing with their bank within 70 days of the transaction, or 120 days if the contract between them provides for this. The amounts debited are refunded by the bank within a maximum of one month after receipt of the written dispute submitted by the cardholder. No fees for the refund of the amounts may be charged to the cardholder.
The buyer may also pay by bank transfer to the bank account of the company Comme un diadème, which will be communicated to them by email, or via PayPal.
Payment in installments is possible by credit card via PayLater (payment in 3 or 4 installments, via Oney) and PayPal (payment in 4 installments with no fees).
To view Oney's Terms and Conditions, please click on this link:

The customer hereby accepts Oney's legal notices, which can be found here:https://www.payplug.com/hubfs/payplug-oney/cgv.pdf
Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgment of full knowledge thereof, and waiver of the right to invoke one's own terms and conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has entered it on the order form, Comme un diadème will send confirmation of the order by email.
If the buyer wishes to contact Comme un diadème, they may do so either by mail at the following address: Comme un diadème S.A.S., 288A Montée Rouge, 30310 Vergèze, France; or by email at the following address: contact@commeundiademe.com.
Article 5. Retention of title
Comme un diadème retains full ownership of the products sold until full payment has been received, including the principal amount, fees, and taxes.
Article 6. Withdrawal
Under Article L121-20 of the French Consumer Code, in the European Union, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for a refund without penalty, except for the cost of return by Colissimo with delivery against signature or any other delivery system. Delivery with signature upon delivery is strongly recommended in order to avoid any loss of the package. In the event of withdrawal, the customer must be able to provide proof of return of the package if necessary.
The withdrawal request must be sent only to contact@commeundiademe.com or via the return form on the website. Withdrawal requests must not be sent via private messages on social media (Facebook or Instagram). The return form is available in the contact section of the website, after logging into your customer account.
The product must then be returned in the same condition as it was sent, in its original packaging intact. Refunds will only be issued if the product has not been washed, curled, cut, styled, or damaged. The parting of the product must be positioned in the center. The product will be carefully inspected before a refund is issued. The lace part of lace wigs must not have been cut. If the product requires re-shampooing (application of serum or other product to the hair), a penalty of €30 will be applied to the refund. If the product is returned with a clip that has been unstitched or torn off, a penalty of €30 per clip will be applied. The outer packaging must also not be damaged, otherwise a penalty of €10 will be applied.
In the event of an order for a product outside the European Union, the buyer will also be fully refunded if the product is returned. The buyer has a period of 5 working days to notify the company of their withdrawal. They must also return the product via the carrier of their choice within 5 working days. The customer must be able to provide proof of return of the package if necessary.
Credit card fees and other related costs (e.g., customs fees) are also non-refundable. When returning a product shipped outside the EU, the customer must ensure that the return formalities do not result in customs clearance fees for the seller, as this is not an import but a product return. You must declare "Return of product to seller." In the event of an error on the part of the customer, customs clearance fees will be deducted from the refund.
Custom orders are payable in advance and are non-refundable. Production times can be long (around 3 months, sometimes a little longer). Exceeding the delivery time for the product will not be grounds for a refund.
Products that have been cut or modified specifically at the customer's request at the time of ordering (bangs, curtain bangs, Diadem cut, addition of adhesive tape) via the "available options" form are not eligible for the return policy.
Products ordered following a face-to-face meeting (for example, with a MEETING code) are not eligible for return.
The return of a product that is not eligible for the return policy (custom order, product cut to order) will be shipped back at the customer's expense.
In certain cases and upon specific request from the customer, a root effect may be applied to a new product or a product previously purchased from Comme un diadème for a fee. As the service is provided remotely, the color achieved will be as close as possible to what is requested and cannot be refunded in case of dissatisfaction.
Tickets for Comme un diadème events are non-exchangeable and non-refundable. The ticket price is deductible from the purchase of a topper wig, on site, on the day of the event.
Article 7. Delivery
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders for toppers and wigs are shipped by DHL. Orders for hair buns are shipped by Colissimo and sensitive grips by regular mail. Delivery times are given for information purposes only; if they exceed thirty days from the date of the order, the sales contract may be terminated and the buyer reimbursed. Comme un diadème may provide the buyer with the tracking number for their package by email. The buyer will receive their order at their home address via DHL delivery, or at a DHL pick-up point. Transport risks are borne by the buyer from the moment the items leave the premises of Comme un diadème. The buyer is required to check the condition of the packaging and the contents of the goods upon delivery in the presence of the delivery person. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery. For deliveries outside mainland France, the buyer undertakes to pay all taxes (customs duties, VAT, etc.) due under the laws of the country receiving the order.
Article 8. Warranty
All products supplied by Comme un diadème are covered by the legal warranty provided for in Articles 1641 et seq. of the Civil Code.
